A Vermont judge has tossed the custody case involving two lesbians to a Virginia judge. The lawsuit concerns a lesbian couple who cohabited in Vermont. One had a baby, but when the biological mother converted to Christianity, she broke off the relationship and moved to Virginia. Attorney Matt Krause of Liberty Counsel says the Vermont judge ruled in an unexpected way.

“The courts in Vermont took the unprecedented step of taking custody out of the hands of a biological mother and transferring it to a stranger…who has only known the little girl in question for about 18 months,” Krause reports.

The attorney feels the Vermont judge, who refuses to recognize Virginia law, is not focusing so much on the custody issue as he is on forcing a higher court to consider the case on the basis of the full faith and credit clause, which deals with states respecting the laws of other states.
