Erskine College lawsuit decision appears to favor Plaintiffs, but judge needs more time.

Written by Don K. Clements | Tuesday, April 6, 2010

Several ARP Synod related blogs, as well as the Anderson, SC Independent Mail web site are reporting that the judge who held the last hearing on the Temporary Restraining Order against the Synod, extended the TRO awaiting final drafting of an injunction.

Several sources have reported that the Judge, with the consent of the ARP Synod lead attorney, has asked the lead attorney for the Plaintiffs to be involved in the drafting of the injunction.

An injunction would be an order finding in favor of the plaintiffs, meaning that the ARP Synod would be blocked from proceeding on the plans approved at the Called Meeting in March for changing the makeup of the board of Erskine College until the case is finally decided.

If the injection is put in place, it appears that the docket of the Abbeville, SC courthouse, where the case was filed, does not have a date available to try the case for nearly a year.

The Moderator’s Commission of the ARP Synod is expected to meet as soon as the final order from Judge Griffeth is release.
